TERMS AND CONDITIONS OF THE FINESTSCALEUP.LEARNINGSPACE.APP WEBSITE
I. GENERAL PROVISIONS
- These Terms and Conditions define the general conditions, rules, and manner of providing services electronically through the website https://finestscaleup.learningspace.app/ (hereinafter referred to as the „Website” or the „Service”) as part of the FINEST SCALEUP project, hereinafter referred to as the „Service Provider.”
- The website is informational. Through the Service, the Service Provider provides information on innovation ecosystems in BSR-5 countries.
- Contact with the Service Provider is made via email: rodo@digitalknowledge.pl.
- These Terms and Conditions are continuously and freely available on the website finestscaleup.learningspace.app, allowing users to obtain, reproduce, and save their content by printing or saving on a medium at any time using the IT system they are using.
- All rights to the Website, including proprietary copyrights, intellectual property rights to its name, domain, website, as well as forms and logos, belong to the Service Provider, and their use may only occur in the manner specified and consistent with these Terms and Conditions.
- The Service Provider informs that using services provided electronically may pose risks to every Internet user, including the possibility of introducing harmful software into the User’s IT system and the unauthorized acquisition and modification of their data. To minimize the risk of such threats, the User should apply appropriate technical measures, particularly antivirus software and a firewall.
The terms used in this document have the following meanings:BSR-5: Refers to the innovation ecosystems in five (5) EU member states in the Baltic Sea region (BSR), actively represented by project partners. II. DEFINITIONS
The terms used in this document have the following meanings:
BSR-5: Refers to the innovation ecosystems in five (5) EU member states in the Baltic Sea region (BSR), actively represented by project partners. Namely: Estonia, Latvia, Lithuania, Finland, and Poland.
Civil Code: The Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended).
Consumer: A User who is a consumer as defined in Article 22[1] of the Civil Code.
Account: The portion of the Website assigned to a particular User through which the User can access the Website.
Entrepreneur: A client who is an entrepreneur as defined in Article 43[1] of the Civil Code.
Terms and Conditions: This document.
Registration: A one-time action involving the creation of a User Account on the Website as outlined in these Terms and Conditions.
Website/Service: The website available at finestscaleup.learningspace.app, owned and operated by the Service Provider.
User: A natural person with full legal capacity, a sole trader, legal entity, or an organizational unit without legal personality that can use the Services available on the Website.
Services: The services provided electronically by the Service Provider to Users of the Website.
Consumer Rights Act: The Act of May 30, 2014, on consumer rights (Journal of Laws 2014, No. 827).
Act on the Provision of Electronic Services: The Act of July 18, 2002, on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended).
III. RULES OF USING THE WEBSITE
- The Service Provider enables Users to use the services provided through the Website and view the information available on the Website.
- Using the Website is only possible under the terms and within the scope specified in these Terms and Conditions.
- The minimum technical requirements to use the Website and Services:
– A device with Internet access;
– Access to email;
– The latest version of an internet browser with Cookies and JavaScript enabled;
– A program to read PDF files. - Users are prohibited from using the Website or Services in violation of the law, good practices, the personal rights of third parties, or the legitimate interests of the Service Provider.
IV. ELECTRONIC SERVICES
- The provision of Services is conducted under the terms specified in this document.
- The services provided by the Service Provider to Users are free of charge, as stated on the Website and according to these Terms and Conditions.
- To use the electronic services available on the Website, an Account must be created.
- The Service Provider enables the creation and maintenance of an Account through the Website. The rules for the creation and maintenance of an Account are described in section V below.
- For Users who have an Account and are logged into it, the Service Provider provides through the Website:
– Viewing information posted on the Website;
– Access to a forum for Users;
– Use of the events calendar. - The Website presents information and other content in accordance with the theme and nature of the Website.
- The agreement for the service of viewing information posted on the Website is concluded for a fixed term and terminates when the User closes the Website or logs out.
- The agreement for the service of using the search tools available on the Website is concluded for a fixed term and terminates when the search term is entered and the dedicated search button is pressed.
- The agreement for the service of making settings within the Account is concluded for a fixed term and terminates when the settings are saved.
V. ACCOUNT
- Using the Website, including viewing the content presented on the Website and using the electronic services provided therein, requires the User to register an Account and log in to it.
- The service of maintaining an Account on the Website is available after registration. Registration occurs by completing and accepting the registration form provided on the Website.
- A User cannot have more than one Account associated with a single email address.
- Users are prohibited from using other Users’ Accounts or allowing others to use their Account, including disclosing their Account password.
- By registering an Account, the User declares that the information provided in the registration form is true and does not infringe the rights of third parties. The User may update the information provided after registration.
- The Account contains the User’s information provided during Registration and information edited by the User voluntarily after Registration.
- In case of violation of these Terms and Conditions by a Consumer User, the Service Provider may terminate the agreement for services with a 14-day notice, following a prior ineffective request to stop or remove the violation.
- In the case of a violation of these Terms and Conditions by an Entrepreneur User, the Service Provider may terminate the agreement immediately (delete the Account) or suspend its performance within the Account.
- The agreement for the service of maintaining an Account is concluded for an indefinite period and is terminated upon deletion of the Account by the Service Provider as described above or by the User’s request to delete the Account.
VI. USER RIGHTS AND OBLIGATIONS
- Users are required to:
– Use the Website in compliance with the law, good practices, and these Terms and Conditions, respecting the personal rights and intellectual property of third parties;
– Not use devices, software, or methods that may disrupt the operation of the Website;
– Not submit unlawful content;
– Not post content unrelated to the Website’s theme, including advertising or marketing content;
– Provide their contact details only in designated areas of the Website. - Users may not engage in activities that would burden the Service Provider’s inboxes, particularly by sending advertising messages.
- Users may use the materials, information, and other content presented on the Website only for personal use under these Terms and Conditions for the duration of the agreement for services. Public dissemination of such content or any adaptations, including commercial use, translation, or modifications, is prohibited.
- A Consumer may withdraw from the agreement concluded remotely (including service agreements) without providing a reason within 14 days by submitting an appropriate statement to the Service Provider. The User may use the form available on the Website for this purpose.
- According to the Consumer Rights Act, the right of withdrawal does not apply in certain cases specified in Article 38, paragraphs 1 and 2 of the Act.
VII. COMPLAINTS REGARDING ELECTRONIC SERVICES
- Users may submit complaints to the Service Provider regarding the functioning of the Website and the use of Services. Complaints can be submitted in writing via email: rodo@digitalknowledge.pl.
- The complaint should include the User’s name, correspondence address, and the type and description of the problem encountered.
- The Service Provider undertakes to review each complaint within 14 days. In the case of missing information in the complaint, the Service Provider will request the User to provide the necessary details within 7 days of receiving the request.
VIII. OUT-OF-COURT METHODS FOR COMPLAINT RESOLUTION AND CLAIMS ENFORCEMENT
- A Consumer User has several options for out-of-court complaint resolution and claims enforcement:
– They can apply to a permanent consumer arbitration court operating at the Trade Inspection for a dispute arising from a service agreement;
– They can apply to the provincial inspector of the Trade Inspection to initiate mediation to amicably resolve the dispute between the User and the Service Provider;
– They can seek free assistance in resolving a dispute between the User and the Service Provider, including through the Consumer Federation, the Association of Polish Consumers, or other social organizations. Advice is available from the Consumer Federation at the free consumer helpline 800 007 707 or the Association of Polish Consumers at porady@dlakonsumentow.pl;
– They may submit a complaint through the EU online dispute resolution platform available at http://ec.europa.eu/consumers/odr/. - Information on accessing these procedures is available at www.uokik.gov.pl under the section “Consumer Dispute Resolution.”
IX. PERSONAL DATA PROTECTION
The personal data provided by Users may be collected and processed by the Service Provider in accordance with applicable law and the Privacy Policy available on the Website.
X. FINAL PROVISIONS
If an Account-holding User does not accept the new content of the Terms and Conditions, they must notify the Service Provider within 14 days of being informed of the changes. Failure to accept the new Terms and Conditions will result in the termination of the service agreement for the Account.
The only source of obligations for the Service Provider is these Terms and Conditions and mandatory legal provisions.
The Terms and Conditions are available in Polish and English.
Reproduction or publication of these Terms and Conditions or any part thereof without the written consent of the Service Provider is prohibited.
The provisions of these Terms and Conditions regarding withdrawal from the agreement, complaints, changes to the Terms and Conditions, and jurisdiction apply to a natural person entering into an agreement directly related to their business, where the agreement does not have a professional character for that person.
Unless otherwise provided by mandatory legal provisions, Polish law governs any disputes arising from these Terms and Conditions.
Disputes between the Service Provider and an Entrepreneur User will be resolved by a common court of law competent for the location of the Service Provider’s registered office.
The Terms and Conditions may be subject to changes. Any changes will be communicated to Users through information on the Website’s main page, containing a summary of the changes and their effective date. Users with an Account will also be informed via email. The effective date of the changes will not be earlier than 14 days from their announcement.
